Terms and Conditions of Use – A Feat of Hands PLLC


Welcome to the website for A Feat of Hands PLLC (the "Massage Therapist"). Please read these Terms and Conditions of Use (the "Terms") carefully before using this website or accessing any of the Massage Therapist's services.

  1. Website and Services. This website is owned and operated by the Massage Therapist, who provides professional massage therapy and related wellness services (the "Services") to clients. 

  2. Acceptance of Terms. By accessing or using this website, you agree to be bound by these Terms, as well as the Massage Therapist's Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you are not authorized to use this website or the Services. 

  3. Use of the Website and Services.  By using the website and Services:


a) You confirm that you are age 18 years or older or have the express consent of a parent or guardian if under the age of 18.

b) You may use the website and Services solely for your personal, non-commercial purposes. You shall not use the website or Services for any unlawful or prohibited purpose.

c) You agree to provide accurate, current, and complete information when registering for or using the website or Services.

d) You are responsible for maintaining the confidentiality of any login credentials associated with your use of the website or Services.

e) The Massage Therapist reserves the right to modify, suspend, or discontinue the website or Services, in whole or in part, at any time, with or without notice to you.


4. User Responsibility and Account Management.  When creating an account with the Massage Therapist, you are solely responsible for maintaining the confidentiality and security of your account credentials, including your username and password. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. You agree to use strong, unique passwords for your account, and we may periodically require you to change your password to enhance security.


5. Massage Therapy Services. 

a) The Massage Therapist shall provide the massage therapy Services in a professional and competent manner, in accordance with applicable laws, regulations, and industry standards, including but not limited to [list relevant industry regulations and guidelines].

b) The Massage Therapist expressly disclaims any and all guarantees, warranties, or representations, whether express or implied, regarding the effectiveness, outcomes, or results of the massage therapy Services. No warranty of fitness for a particular purpose or warranty of merchantability shall apply to the Services. Individual results may vary, and no specific outcome can be promised or guaranteed.

c) You agree to provide accurate and complete information about your medical history, any injuries or conditions, and any medications you are taking, which may affect your suitability for massage therapy.

d) You understand and acknowledge that massage therapy may have certain risks, including but not limited to temporary muscle soreness, discomfort, or in rare cases, more serious injuries. You agree to follow the Massage Therapist's instructions and recommendations to minimize any potential risks.

e) You understand that the Massage Therapist has a twenty-four (24)-hour cancellation policy.  There are no penalties for cancelling a booked Service 24 hours or more before the appointment time.  Cancelling less than 24 hours, or not showing for your booked appointment, will incur a $50 fee for 60-minute sessions, and a $75 fee for 90-minute sessions.

f) You understand that if you are more than fifteen (15) minutes late for a booked Service, your appointment will be cancelled, and you will be charged a cancellation fee based on the duration of your appointment, per Section 5(e) of these Terms. 


6. Intellectual Property. The website and all of its content, including but not limited to text, graphics, logos, images, and any client-specific information or data collected through the website or Services, are the sole and exclusive property of the Massage Therapist or its licensors and are protected by copyright, trademark, and other intellectual property laws.


You may not modify, copy, distribute, transmit, display, reproduce, or create derivative works from the website, its content, or any client-specific information without the Massage Therapist's prior written consent.


The Massage Therapist retains all right, title, and interest in and to any client-specific information or data collected through the website or Services, subject to applicable privacy laws and regulations.


7. Limitations of Liability. To the fullest extent permitted by law, the Massage Therapist shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising out of or related to your use of the website or Services, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, even if the Massage Therapist has been advised of the possibility of such damages.


Without limiting the foregoing, the Massage Therapist shall not be liable for any   claims, damages, or losses arising from or related to:


a) The use or inability to use the website or Services;

b) Any action taken in connection with an investigation by the Massage Therapist or law enforcement authorities regarding your use of the website or Services;

c) Any errors or omissions in the website's or Services' content or functionality;

d) Any damage to your computer, mobile device, or other equipment or technology, including damage from any security breach or from any virus, bugs, tampering, fraud, error, omission, interruption, defect, delay in operation or transmission, computer line or network failure, or any other technical or other malfunction;

e) Any injuries, adverse reactions, or other health-related issues resulting from the massage therapy Services, provided that the Massage Therapist has not acted negligently or in violation of applicable professional standards.


The Massage Therapist's total liability to you for all claims, whether in contract, tort (including negligence), or otherwise, shall not exceed the amount paid by you for the Services giving rise to the claim.


8. Indemnification. You agree to indemnify, defend, and hold harmless the Massage Therapist, its affiliates, officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

a) Your use of the website or Services;

b) Your violation of these Terms;

c) Your violation of any rights of a third party, including intellectual property rights or privacy rights;

d) Any content or information you submit, post, or transmit through the website or Services.


Third Party Links. Our website may contain links to third-party websites or resources that are not owned or controlled by the Massage Therapist, and has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or resources.  We do not endorse or make any representations about third-party websites or resources.  You acknowledge and agree that A Feat of Hands PLLC shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any content, goods, or services available on or through any third-party websites or resources. Your use of third-party websites or resources is at your own risk and subject to the terms and conditions of use for such websites or resources. By using our website, you expressly agree that A Feat of Hands PLLC shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses resulting from the use of any third-party links.


A Feat of Hands PLLC reserves the right to disable any links to or from third-party websites or resources at any time without notice. If you find any link on our website that is offensive or inappropriate, you are free to contact and inform us. We will consider requests to remove links, but we are not obligated to do so or to respond directly to you.


9. Disputes. Any dispute, controversy, or claim arising out of or relating to the Terms shall be resolved by binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association (AAA) then in effect. The arbitration shall be conducted by a single arbitrator, unless all parties to the dispute agree otherwise in writing. The arbitration shall take place in King County, Washington, unless the parties mutually agree to a different location. The arbitration shall be initiated by filing a written demand for arbitration with the AAA and serving a copy on the other party. The arbitration shall be conducted in the English language. The arbitrator shall have the power to grant any remedy or relief that they deem just and equitable, including injunctive relief, subject to the terms of this Agreement. The arbitrator's award shall be final and binding on all parties, and judgment may be entered upon it in any court having jurisdiction thereof. 


Each party shall bear its own costs and expenses, including attorney's fees, in connection with the arbitration. The fees and expenses of the arbitrator and the AAA shall be shared equally by the parties. All claims and disputes within the scope of this arbitration agreement must be arbitrated on an individual basis and not on a class basis. Any claim or dispute is personal to you and A Feat of Hands PLLC and will be resolved solely through individual arbitration. The parties expressly waive any right to bring or participate in a class, collective, representative, or multi-plaintiff action.


Notwithstanding the foregoing, either party may seek emergency injunctive relief in a court of competent jurisdiction to protect its intellectual property rights or confidential information. Small claims disputes may be resolved in small claims court in lieu of arbitration, where the amount in controversy does not exceed the jurisdictional limits.


10. Governing Law and Jurisdiction. These Terms shall be governed by and construed in accordance with the laws of Washington state, without giving effect to any choice or conflict of law provision or rule.  Any legal action or proceeding related to these Terms or your use of the website or Services shall be brought exclusively in the state and federal courts located in King County, Washington, and you hereby consent to the personal jurisdiction of such courts.


     Notwithstanding the foregoing, the Massage Therapist reserves the right, in its sole discretion, to initiate legal proceedings in any jurisdiction it deems appropriate to seek injunctive relief or other equitable remedies to protect its rights or prevent harm to its interests.


11. Termination. The Massage Therapist may terminate your access to the website or Services at any time, with or without cause, with or without notice. Upon termination, you must cease all use of the website and Services, and all provisions of these Terms that by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability. 


12. Severability. If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole. Such provision shall be changed and interpreted to accomplish the objectives of the provision to the greatest extent possible under applicable law, and the remaining provisions shall continue in full force and effect. 


13. Entire Agreement. These Terms, along with the Massage Therapist's Privacy Policy, constitute the entire agreement between you and the Massage Therapist regarding your use of the website and Services, and supersede any prior or contemporaneous understandings or agreements, whether written or oral. 


14. Changes to Terms. The Massage Therapist reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the website. Your continued use of the website or Services after any such changes constitutes your acceptance of the new Terms.
